    California COVID-19 Law:  Action for Flight Attendants


    The 2022 COVID-19 Supplemental Paid Sick Leave Effective February 19, 2022 – retroactive to January 1, 2022 was put in place to protect employees from COVID-19 absences. 

    Management has taken a position that Flight Attendants are not eligible for these CA benefits, however AFA does not agree. Your Council 15 officers encourage all CA-based Flight Attendants that have COVID-19 related absences to file a wage claim with the state and/or report a labor law violation. AFA has received reports that some California-based F/As have had success filing a claim and potentially will be eligible for compensation if the claim is ultimately resolved in their favor.

    California COVID-19 Law:  Action for Flight Attendants

    Bernstein v. Virgin America

    Many California based Flight Attendants are waiting anxiously to hear updates on Alaska’s decision regarding the Bernstein v. Virgin America lawsuit.  It’s an understatement to say that Alaska caused a lot of stress to CA based F/As with their initial response to the Supreme Court’s decision to reject the case.  To stay updated on what’s new and to hear “both sides of the story,” please be sure to bookmark the Bernstein v. Virgin America subsite created by the attorneys representing the class.  For additional resources, Flight Attendants may also review the recent AFA Status Update from July 11.  

    COVID-19 Tests Provided by SFO International Airport

    On August 2nd, the airport will partner with Safeway to provide 8 COVID-19 Rapid AntigenTest Kits to each employee for free, if your health plan provides for direct coverage, or by reimbursement ($10.99) by your insurance company if you are charged for your test kits (Kaiser members will receive up to 4 test kits). Be sure to bring your employee badge and your insurance card. The morning distribution is scheduled from 0700-1000 at the SFO Maintenance Building #682, and the afternoon distribution is scheduled from 1200-1700 at the Video Art Exhibit Space, near aisle 6 of the International Terminal (pre-security departure level). You can pre-register using this link but walk-ins are also accepted.

    Welcome Trista!

    We are happy to announce that Trista Vanta has been selected as Mobilization Chair for Council 35!  Trista will be coordinating mobilization efforts in SFO as we begin our negotiations this fall.  Learn a little about Trista in her own words:

    “Trista graduated from Virginia Commonwealth University in 2009 with a major in communication arts and a minor in biology. During college, she served as the webmaster Council officer of Filipino Americans Coming Together from 2006-2009, promoting and organizing events to uplift and engage action within the Filipino American community. She also played for VCU’s volleyball club team as the libero and defensive specialist. 

    After graduating, she pursued a career in scientific and medical illustration, working for the Smithsonian National Museum of Natural History. It was 2011 when she decided to enter the aviation industry, inspired by her mom who’s worked for the industry since the 90s. 

    She briefly worked at Air Wisconsin for a little over a year before joining Virgin America in 2013, which became Alaska Airlines in 2016. She is passionate and dedicated to utilizing her past experiences and education to give our workgroup a fair, livable and safe workplace where we are provided with tools to thrive and advance our airline. She believes that unity within the workgroup will be the most valuable driving force in our upcoming negotiation. Her aim in this position is to promote enthusiasm, eagerness and Unity within our workforce to accomplish a common goal. She will strive to balance the interests of our overall workforce, line holders and reserves alike. After all, We are all in it together!”

    Air Safety Health & Security Committee (ASHSC) Update

    Meetings

    Our AFA Air Safety, Health, & Security Committee (ASHSC) Chairpersons met on Thursday, July 14th to discuss our ongoing program of work to represent Flight Attendants interests related to safety, health, and security in our workplace.The Committee also met with management to receive updates and discuss issues and problems that Flight Attendants are facing onboard the aircraft.

    Reports

    Reporting safety concerns is more important than ever given the challenges we are currently facing as a work group.  Flight Attendant Irregularity Reports (FAIR), Aviation Safety Action Reports (ASAP), and fatigue reports can all be filed through Report It!

    Trash Stowage

    The Inflight Service Committee (ISC) and ASHSC have been working with Inflight and Catering to develop solutions for the ongoing lack of adequate trash stowage. Every departure now should have an empty cart in one of the galleys for trash. If you don’t have the required empty cart, submit both an ASAP and catering report. Catering reports are submitted via Block2Block.  Please submit an ASAP & FAIR if, after following procedures and making every reasonable attempt to do so, you are unable to stow all trash in legal stowage locations. AFA continues to advocate for dedicated trash cart(s) on all flights.

    Time In Motion Study

    The ASHSC is coordinating with the Inflight Service Committee and Inflight on a program to assess how long it takes to perform safety and service duties on each aircraft type and flight profile. The goal is to understand what service can safely be completed in each market, and ensure we have adequate time allotted for safety duties like equipment checks and briefings.

    Cabin Lighting

    During Compliance Checks  The ASHSC has been advocating for a brighter lighting setting prior to take off and landing compliance checks. We believe the company is willing to use our boarding light setting for compliance checks and expect the change to be implemented soon. The brighter lighting will help us see better as we complete our compliance checks and will provide a visual indicator to passengers that their attention is needed as we prepare the cabin for landing.

    COVID Exposure: Differences in Company and CDC Guidance

    • Management has developed guidance on how to deal with COVID-19 exposure that uses different terminology, definitions, and recommendations than the guidance currently offered by the Centers for Disease Control & Prevention (CDC).
    • To most effectively manage your personal risk in the event of an exposure, it’s helpful to understand how management’s definitions and guidance compare to the CDC guidance.
    • More information about CDC guidance for both vaccinated and unvaccinated individuals can be found on the CDC website.

    Fortunately, we are in a period of relatively low COVID-19 transmission and reported hospitalizations and deaths continue to trend downward. Despite low case counts, there is the possibility that another spike in COVID-19 cases could occur if new variants emerge and precautions like mask mandates and social distancing are reduced.

    To help understand and manage your personal risk as we enter this next phase of the pandemic, it is helpful to know how the Company handles and communicates known COVID-19 exposures and how that differs from current CDC guidance.  The Company has created two categories of exposure, “low risk” and “high risk”. 

    Company Defined “Low Risk Exposure” – It is AFA’s understanding that the Company’s “low risk exposure” is essentially the same as the CDC’s “close contact”.  This occurs when you were less than 6 feet away from an infectious person for a cumulative total of 15 minutes or more over a 24-hour period.  A person is considered infectious starting 2 days before they have any symptoms, or if asymptomatic 2 days before taking a test which came back positive for COVID-19.

    Company Defined “High Risk Exposure” – This differs significantly from the CDC’s definition of “close contact”.  To qualify as “high risk exposure”, the person you were less than 6 feet away from for a cumulative 15 minutes over a 24-hour period must also have symptoms of COVID-19 while (or within two days of the time that) you were with them. One of you must also have been without a mask.  If the exposure was to an asymptomatic COVID-19 positive individual or you were both wearing a mask, it will not be classified as “high risk”. As you can see, this greatly reduces the chance of an exposure being categorized as “high risk”.

    To manage risk, we recommend that you treat notifications of “low risk” exposure from the Company as “close contact” as defined by the CDC.

    If you are up-to-date on COVID-19 vaccinations or have had a confirmed case of COVID-19 within the past 90 days, it is not necessary to quarantine.  However, the CDC still recommends that you take certain precautions.  Even if you don’t develop symptoms, get tested at least 5 days after you last had CDC defined “close contact” with (or Company defined “high risk” or “low risk” exposure to) someone with COVID-19. Until 10 days after that contact/exposure you should also watch for symptoms, isolate if you develop symptoms, wear a well-fitted mask any time you are around others, and avoid being around people who are at high risk.

    Management Eliminates Remaining Pay Protection and Points Reduction Related to COVID-19 Effective Today

    • Management eliminated all remaining COVID pay protection and attendance points forgiveness, effective today.
    • Going forward, Flight Attendants who experience COVID-related illnesses–even if attributed to workplace exposure—will be forced to use sick leave to replace lost income during Company-directed quarantine and will be subject to attendance points in accordance with Section 32 of our contract.
    • AFA leadership attempted to work with management to enter into an agreement for continued attendance points forgiveness related to COVID-19, but management declined to engage.

    As indicated in “Further COVID Policy Changes” which was emailed to all employees on March 10th, Alaska Airlines management eliminated all remaining pay protection and Attendance Policy points reduction related to COVID-19, effective today. Management cited employee rates of infection having dropped “to only a handful of cases this week,” “vaccinated employees…staying out of the hospital even if they get infected,” and overall “lower risk to our employees” as justification for this most recent policy change.

    Although those statements are currently true—and we hope that they remain true, AFA Alaska leadership strongly disagrees with management’s decision. Until the World Health Organization (WHO) or the U.S. Center for Disease Control (CDC) officially reclassifies COVID-19 from a pandemic to an endemic disease, then pushing financial and work performance ‘liability’ for this disease to employees is, in the MEC’s opinion, premature.

    AFA leadership would be remiss if we overlooked the other commercial factors that management did not acknowledge:

    • Shifting pay replacement for absences related to COVID-19 from the Company to employees’ respective personal sick (or PTO) banks minimizes the Company’s pandemic-related financial burden; and
    • Assessing attendance points (or similar work performance ‘demerits’) to employees for absences related to COVID-19 may lead to increased reluctance by employees to call out sick for other issues, which potentially minimizes pandemic-related operational challenges and inefficiencies—and ultimately improves the bottom line in a roundabout way.

    Management advised AFA leadership of the plan to return to situation normal some weeks ago, and we lodged our pandemic vs. endemic objections at that time. Whether it was because of pushback from union leadership or perhaps other factors, management temporarily delayed rollout. However, management was unwilling to wait any longer.

    The MEC also requested that the parties bargain on another temporary agreement for point reduction related to COVID-19 absences similar to AFA MOU “§32 Attendance Policy Points Related to COVID-19” that expired on September 30, 2021. Unfortunately, management declined to engage.

    SFO Employee COVID Testing

    As a result of new CA State legislation, one of SFO’s COVID-19 testing sites will now accept insurance (including Kaiser) and has set up a dedicated Employee Testing portal for all Airport workers. Links to the portal for employee registration at this site offering molecular testing is below. Advance registration is required via the Employee Portal. Employees who are symptomatic or are known to be in close contact with someone who has tested positive for COVID-19 should use Worksite Labs if possible.

    Location: Adjacent to the Long-Term Parking Lot and Cell Phone Waiting Lot by San Bruno Avenue

    Testing Offered: Drive-Thru Only, RT-PCR with results in 12 or 24 hours

    Employee Testing Hours: Daily 0700-1900

    Sunsetting of NavBlue Classbid After the March 5-12, 2002 Bid Period

    NavBlue is sunsetting the old Classbid interface and FAs will need to use the updated WebApp interface for the March 5-12 bid period. Base Sits for SFO are scheduled on the dates below, and will be held in the SFO Village.

    Pairing Update for March 2022

    The company has been trying to find ways to mitigate their operational risk of cancellations due to crew staffing shortages. They have found that the average sick call on a 4 day can take 2 or 3 reserve flight attendants to staff because of reserve legalities and days-on availability. This has led the company to significantly reduce 4 days in all bases for March. 

    We have let crew planning know that we are very unhappy with this as it relates to the SFO base, and stressed that the quality of pairings is an issue, not quantity. If you have any feedback please reach out to sfo.scheduling@afaalaska.org so that we can relay any feedback to management.

    Many in our base rely on longer trips. There are some tips to try and create your own longer pairings should you want to attempt it. You can attach one trip to another by adding a base turn (JCBA 8.T) to the beginning or end of another trip. A base turn isn’t necessarily a ‘turn’ but is “two (2) sequences combined in the same duty period that contain no less than one hour and forty-five minutes (1:45) block-to-block between the last flight of the previous sequence and the first flight of the subsequent sequence. The scheduled ‘base turn duty period’ cannot exceed fourteen (14) hours on duty according to CFRs.” Additionally, some trips have a SIP (JCBA 12.G),(a Sequence Interruption Point [SIP] will be any arrival of the aircraft at the Sequence Home Domicile). You can pick up a trip out of open time that in its entirety may not be legal to add, but with a SIP in base could create a legal combination. With many of the pairings we have, these tools may not always be applicable but we wanted to make sure that this information was available to you should you want and be able to use it.

    Calling in Sick and Wellness Calls

    As everyone knows, thanks to the many reminders from management, sick leave usage is at an all time high.  Considering there’s a world-wide pandemic occurring this is not surprising.  One way management has taken steps to attempt to curb sick leave usage is to carefully monitor sick calls.  Many of the “suspect” cases are brought to the performance team for investigation from Crew Scheduling.  When an FA calls in sick and offers more information than what is needed, this often will trigger a “red flag” and get passed along for an investigation.  Best practice is to say only what is necessary to crew scheduling when calling in to report an absence.  “Hi this is FA (name)  Peoplesoft number (1234567) calling in sick for (trip number or reserve day).”  Nothing more is needed.  If schedulers are asking for more information, you are not required to divulge any health information.  

    The same guidance is also true for Wellness calls.  Management has a process in place to follow up with Flight Attendants when they reach certain absence point levels.  Normally each discipline level triggers a wellness call and/or email from base supervisors. Wellness calls with management do not require a response, however it is recommended that the FA provide a confirmation of the message.  In recent investigations with FAs with high point levels, one of the questions from the performance supervisor is “did you receive the wellness calls from base leadership?  And did you respond?”  Best practice would be to respond via email only to any wellness calls and/or emails to avoid having a conversation with management without Union representation.

    Member Question: How to use sick family

    Flight Attendants can use sick leave to tend to a serious or emergency health condition of a family member.  If you report sick for a qualified family member and do not have enough sick leave to cover the entire sequence or reserve day(s), the absence(s) will be converted to a Management Drop and attendance points will be assessed at a half-point per day. To see your sick leave balance log into Rainmaker for the most current balance. If you need time away from work to care for a sick family member and you do not have sufficient sick leave available, contact an Inflight Supervisor to request a Management Drop.     Our AFA Inflight Service Committee Chairpersons met on November 29 to represent Flight Attendants' interests related to catering and onboard service/sales. The Committee met with management to discuss and receive updates on issues and problems faced by Flight Attendants onboard. The Committee continues to work with management to address catering concerns and improve processes in the future.     Our AFA Alaska Master Executive Council (MEC) met this week on Wednesday, December 6, to conduct their ongoing work to represent our Flight Attendants. The MEC’s quarterly meeting with executive management and a group of union leaders from other company workgroups was postponed due to the merger announcement and other scheduling conflicts. The next Regular MEC Meeting is scheduled for Tuesday, January 9, and Wednesday, January 10.
    Alaska Flight Attendants are struggling to afford living expenses, let alone enjoy holiday shopping for their loved ones. It’s time for Alaska management to prove they care with an industry leading contract!
    On December 14, 2023, United Airlines Flight Attendants will take to the picket line - their holiday spirit of unity and solidarity burning brighter than ever. They are determined to strengthen their power and demonstrate their unwavering commitment to securing a contract that genuinely values their work and contributions to United Airlines. As holiday travelers take to the skies, United AFA Flight Attendants will ensure their voices are heard loud and clear. They are unified and ready to do "Whatever It Takes" to get the contract they have rightfully earned!
    Starting a career as a Flight Attendant is more challenging than ever due to low pay rates that haven't kept up with the cost of living. Many new Flight Attendants face difficulties securing housing and food in expensive cities where they are based. Our EAP Committee has created a new website page with comprehensive information on resources to help Flight Attendants overcome these obstacles.
    Fume events can occur on flights for various reasons, such as oil leaks or mechanical issues. Familiarize yourself with the symptoms of air quality, fume, and hypoxic events, so you know what to do if you suspect one is happening. More resources are available on the Air Quality Subcommittee page of the AFA Alaska website.
