        Bernstein v. Virgin America Ruling


        Since the ruling was announced (06/30/2022) Council 15 LEC Officers have been inundated with questions related to the potential impact to our base.  At this point, we do not believe any decisions have been made. I personally feel the company has created unneeded panic before there is even a plan going forward.

        Please review the following communications from AFA and look for updates as more information becomes available. 

        AFA News Now – Supreme Court Ruling on Bernstein v. Virgin America
        Alaska MEC 
        (06/30/2022)

        “In our opinion, management’s various communications are largely speculative and suggest that somehow safety provisions and meal and rest breaks cannot coexist. Arguably, the meal & rest requirements are applicable only to CA-based FAs working for a CA-based airline solely on intra-CA flights (e.g., SFO-LAX but not SFO-JFK).Rather than focus on practical solutions, management simply continues to gripe about having to comply with this law. As the 9thCircuit Court of Appeals already told them more than a year ago, there are many ways to comply with this law.”

        Meal and Rest- Don’t Exempt, Negotiate 
        AFA International (05/27/2022)

        “Instead of meaningfully seeking to address the provisions of the law, airline executives have argued the most onerous outcomes of applied law. For example, one argument the industry makes is that this law will require augmenting crew on long haul flights. They mount this argument despite the fact that the case is limited to California-based flight attendants flying in California. The court did not address the applicability of meal and rest provisions to long-haul flying, which primarily would take place outside of California and therefore may not even fall under this law.”

         AFA stands ready to work out a solution with management that is compliant with the law and is a mutually agreeable path forward for all stakeholders.


        SAN Mobilization Chair Selected for Negotiations


        We would like to thank those who expressed interest for the San Diego Mobilization Chair. Both candidates showed passion, knowledge, and drive and we were excited to have such strong candidates. With that being said, Samantha Wolff has been selected and accepted the position. She will attend training at the beginning of August with the other local mobilization chairs. More opportunities to get involved with the committee will be announced later this summer.

        Samantha began her career as a flight attendant flying for Virgin America in 2011. She quickly upgraded to Inflight Team Leader which was the airline’s purser position, and flew as the ITL until the merger with Alaska Airlines in 2018.

        She has a bachelor’s degree in fine art and is a painter, sculptor and photographer. She also has a background as a legal assistant. She and her husband, who is an Alaska captain and ALPA volunteer, are empty nesters for his 2 adult sons and they currently live in San Diego with their 3 rescue cats.

        She is a passionate union advocate and although this is her first volunteer position with AFA, she is dedicated to provide our union members with timely information during membership surveys, contract negotiations and voting.

        Negotiations Survey Coming Soon


        Get Ready for Our Negotiations Survey—Update Your Contact Information Now!
        In just a few months, our Negotiating Committee will be conducting a Negotiations Survey of all Flight Attendants.  The survey results will be used to help our Negotiating Committee prepare our Opening Proposal.  When it’s ready to launch, the survey will be sent out to all Flight Attendants using the contact information on file with AFA.  If your contact information has recently changed, update it as soon as possible so you can receive your invitation to complete the survey.         Local Committee Updates


        We have made some changes and additions to a couple of the committees

        Reserve Committee

        We want to welcome Rebecca Garcia as the New Reserve Chair and thank Joe Coneglio for his time as Reserve Chair.

        New to Reserve? Familiarize yourself with Reserve [Section 11] & Hours of Service [Section 8] of the Contract and the Reserve Survival Guide.  It may be found on your IMD. Search “Reserve” or go to ASFA Supplemental> Collective Bargaining Agreement> AFA Alaska Reserve Survival Guide. 

        If you believe you have received an illegal assignment, don’t hesitate to contact our local Reserve Committee.  They have been helping members work through their concerns. When a contractual violation is identified- they can assist you.

        San Diego Committee Update


        We would like to welcome Joe Coneglio to the Reserve Committee (chair), Vanessa Woods to Air Safety, Health & Security and Pablo Fregosa to Government Affairs. Reach any of our committee members at http://www.afaalaska.org under the SAN committee tab.

        It’s a busy time of year for our scheduling chair JR (Jack) George. To help lighten his load, we ask that you use the local San Diego scheduling email address for all questions: san.scheduling@afaalaska.org, you can also copy in your Officers at san@afaalaska.org.

        Please do not send text messages, IM’s or tag us in Facebook, it is too hard for us to monitor. Many times the information needs to be forwarded to other individuals and an email (with snap/screen shots) is the format that helps us, help you!


        JCTE


        We are well aware that there are continuing problems with JCTE (Crew Access) and with payroll errors. Please go to support.afaalaska.org to report payroll issues, scheduling problems and reserve concerns. Not only does this provide an opportunity for AFA to track trends in order to resolve problems, but also it allows us to research each individual situation and respond.

        We are finding that many Flight Attendants do not know how to track their hours and pay. Our payroll system is very complex with all the different rates, depending on each situation. The following guidelines may be helpful:

        ·       Flight Crew Pay Sheets live forever, unlike Rosters, which currently vaporize after 60 days. To see a print out of what you were paid for, look at the Pay sheet for the month at issue. You will also find your running sick leave usage and vacation totals in the upper right-hand corner of each sheet.

        ·       Save your original line award. Keep a screenshot of every change you make to your awarded line, and in particularly any trips that operate irregularly. Do the same with reserve assignments. This is the material you’ll need to determine whether or not you were paid properly for your flying or reserve duty, and to determine leave eligibility continuing health care benefits and vacation accrual during a leave.

        With the start of winter, and the attendance issues, please copy and print or bookmark the following information to assist you in determining your legalities and pay:  http://afanewsletters.org/docs/2/Irregular%20Operations.pdf.

        We know that this feels like extra work and agree that it shouldn’t be necessary. It will be necessary information in order to file a ticket at support.afaalaska.org, so that we can resolve your issues as quickly as possible. Without supporting documentation, which can be easily attached to a ticket, it is much more difficult and time consuming to resolve individual issues and to track larger problems. Please know that we are working diligently to ensure that each problem is addressed and rectified as quickly as possible.


        Recurrent Training


        If you are having any significant problems with the Cornerstone app, please reach out to one of your Officers and take screenshots if possible. We are always a little concerned when new apps or updates are launched and want to hear how the process is working and that there are no huge issues.

        Speaking of recurrent training, FAs traveling to recurrent from SAN were not getting paid correctly since possibly the implementation of our current CBA 12/14.

        Brice brought this to the companies attention last April. We were receiving 11 tfp when traveling to LGB, but you should have been paid 18.6 (5.8 to travel up, 6 for recurrent, 5.8 to travel back, +1 for an extended duty day = 18.6 tfp plus $75 for doing the at home workbook). An audit has been completed and the pay corrected, but we recommend that you look at your pay sheet and verify for yourself.


        End of Year Reminders


        Remember to convert your unused guest passes before the end of day December 31st.

        Record Improvement S32.G.4– should be applied by mid January, For those of you that had 4 or fewer points at the end of 2017, and you had zero points assessed in NOV, DEC you will be starting 2018 with zero points. Please allow about two to three weeks for the attendance Supervisors to apply your Nov/Dec record improvement. Once this has been done, let us know if there are any discrepancies.


        AFA Council 15 San Diego Facebook Page


        Since the base opened we have been using the SANFA Facebook page, this page is used both for trip trading posts as well as AFA posts. Being as its easy for things to get lost with so many postings, Your AFA Officers started a new “Official” Facebook page called AFA Council 15 San Diego click on the link and like our page, there you can find all the latest news from AFA without having to search through numerous trip trading posts.


        Text Notifications from AFA


        To reach more of our base (including those who are not on social media or don’t check their email often), your LEC Officers started a new way of communicating with our members in San Diego through text message alerts. This program is completely optional. But we feel that it’s a great tool to get information out to everyone quickly. We will not overwhelm you with texts. And we do realize some people may have to pay for texts, so again this program is optional and the information will be available as always on the AFAalaska.org website, emails, and on our Facebook page.

        The enrollment process is simple, all you need to do is send a text message from your personal phone.

        Open your text messaging application. In the send to field enter 81010 and then enter @AFALEC15 in the body of the text and press send.

        You will then receive a reply asking you to enter your full name. Once you send your name, your officers will receive notification and then you are all set to receive texts.

        Please ignore the 3rd question where it asks if you are student or teacher we are borrowing this technology from school districts as to save costs from designing a system or paying a company to send mass texts and you do not need to download the app.

        We hope you like our new service. And as always, we welcome your feedback / questions Please help us spread the word and get your fellow crew signed up.

        AFA Alaska MEC Grievance Update August 2015

        The Master Executive Council (MEC) has recently filed numerous grievances on your behalf.

         

        Grievances Settlements

         

        First and foremost, we filed and settled two very important grievances:

         

        Grievance No. 36-99-2-17-15: Assigning a Failure to Report after Successful Check In.

         

        This grievance was filed due to the Company’s violation of the Collective Bargaining Agreement, Section 32 [Attendance Policy], when it assigned failure to report occurrences after a Flight Attendant’s successful check in.

         

        In certain circumstances management had been assigning a “Late Report” when a Flight Attendant arrived late to the gate or arrived late to the gate at RON, this was after a successful scan in at the beginning of her/his sequence. AFA’s long-standing position has been that “Late Report” occurrences only applied when a Flight Attendant failed to scan in at domicile. All other situations, which might result in a Flight Attendant arriving late to the aircraft, were handled as general performance issues; these will now be referred to as “Late Arrival to Aircraft”. Please note this does not change a Flight Attendant’s requirement to be at the aircraft 45 minutes prior to departure.

         

        Management agreed and a settlement was reached with the following clarifications:

         

        1) A Flight Attendant may only be assessed a Late Report (formerly Failure to Report) when s/he checks in after the scheduled check in time and has not been assessed a No-Show for the same event;

         

        2) When a Flight Attendant is late to the aircraft at any time during a scheduled sequence, s/he will not be assessed any attendance points, these occurrences will be considered a performance issue and will be handled under the Company’s progressive discipline policy; and

         

        3) The Company agrees to remove attendance points from any Flight Attendant who received them for being late to the aircraft during a scheduled sequence, provided the points were assigned in the 18 months preceding May 19, 2015.

         

        If you believe that you may have been assessed a Failure to Report incorrectly and it occurred after November 19, 2013, please reach out to a local grievance representative for assistance.

        Grievance No.: 36-99-2-26-15: Quarterly Productivity Premium.

         

        The second grievance settlement involved Section 21.R [QPP]. It was filed due to Management’s position that Flight Attendants who had not received a PBS bid award for one or more months of the quarter were excluded from the Quarterly Productivity Premium. A copy of the settlement language can be found in its entirety here.

        Grievances Upheld

         

        Management granted the following two grievances:

         

        Grievance No.: 36-99-2-11-15: Violation of Section 27.N [New Hire Initial Training Presentation].

        The Company’s violation of Section 27.N, when it failed to provide the Association one hour for the purpose of new hire orientation during a regularly scheduled training day.

        Resolution: Management has agreed to ensure that a full hour is provided.

         

        Grievance No.: 36-99-2-13-15-Failing to Provide Automated Trading of 4K Pairings.

        The Company’s violation of Section 10.DD.6 [Long Stage Length (“4K”) Duty Period] and 12.C.1 [Trading Procedures], when it failed to automate trading of Long Stage Length Duty Period (“4K”) Pairings. In addition when it violated the Contract Implementation Schedule Letter of Agreement paragraph numbers six* (“One-hundred and twenty days after DOS-but no later than May 1, 2015,…”) and nine* (“The Company agrees to make a good faith effort to meet the above implementation time frames…”), when it failed to notify the Association of the delay and discuss the circumstances and necessary adjustments to the implementation schedule.

        Resolution: Manual trading is in effect until the next emaestro release scheduled for September 15, 2015. Bulletin 2015-0182 issued on July 16, 2015, addresses how to manually trade “4K” pairings.

         

        Grievances Pending

         

        The following grievances have been filed and are still pending:

         

        Grievance No.: 36-99-2-15-15-Limiting Access to the SAN Domicile.

        The Company’s violation of Section 28.I [Company Provided Computers and Printers at Domiciles], when it limited access to the SAN Domicile including contractually required resources to only those Flight Attendants based in SAN.

         

        Grievance No.: 36-99-2-19-15-Failing to Pay Flight Attendants for Reasonable Suspicion Drug/Alcohol Testing.

        The Company’s violation of Addendum to Section 21 [Compensation], when it failed to pay Flight Attendants for reasonable suspicion drug & alcohol testing.

         

        Grievance No.: 36-99-2-20-15-Converting a Line Holding Flight Attendant to ER Reserve Outside of her/his Contactable Period.

        The Company’s violation of Section 11.C.3.b.6 [Conversion of Reserves to ER] and 11.C.3.c [ER Contactibility], when it converted a line holding Flight Attendant to ER Reserve outside of her/his contactable period.

         

        Grievance No.: 36-99-2-21-15-Section 21.M Compensation.

        The Company’s violation of Section 21.M [Pay Protection Due to Weather, Mechanical or to Suit Company Convenience], when it removed a Flight Attendant from a trip and failed to pay protect her.

         

        Grievance No.: 36-99-2-22-15-Violation of Past Practice Regarding Manual Revision/Emergency Interim Bulletin (EIB) Insertion Timelines.

        The Company’s violation of past practice regarding manual revision/emergency interim bulletin (EIB) insertion timelines, which fails to provide Flight Attendants sufficient time to thoroughly read and insert their revisions and/or EIB’s. Long standing past practice is articulated in the Flight Attendant Manual 6.500 page 1, dated July 6, 2012, which states: “Insert, post and record manual revisions within 14 days of receipt, no later than 30 days after distribution.” A new EIB 14-40 effective November 25, 2014, now states: “The holder of the FAM shall insert revisions/EIBs on or before the effective date or prior to the first assignment following the effective date, whichever comes first.”

         

        Grievance No.: 36-99-2-23-15-Beyond Service Training Exceeding Contractual Training Hours.

        The Company’s violation of Section 30.A.2 [Recurrent Training and Other Company-Required (Non-Computer-Based) Training; Hours], by conducting Beyond Service Training after 5:00PM local time, failing to provide a clear break between required training and the optional “Happy Hour” and failing to provide transportation information to Flight Attendants who choose to depart promptly at 5:00PM.

         

        Grievance No.: 36-99-2-24-15-Ground Floor Lodging While on Company Business.

        The Company’s violation of Section 34 [Hotels], when it failed to avoid ground floor lodging for Flight Attendants attending company required Beyond Service training.

         

        Grievance No.: 36-99-2-29-15-Section 28.G.6 Commuter Boarding Priority. The Company’s violation of Section 28.G.6 [Commuter Policy], when it allowed Company employees (and their dependents) on pleasure travel to be given higher boarding priority than commuting Flight Attendants.

         

        * * *

         

        The next step is to move forward to arbitration on any grievances that cannot be resolved appropriately. In addition, we continue to file disciplinary grievances, which occur on a near daily basis.   Many of these will move forward to arbitration as well.   All Flight Attendants system wide are impacted when AFA cannot resolve issues with management prior to arbitration.   AFA is committed to resolving these issues and will soon be scheduling new arbitration dates for the year 2016. Periodic grievance updates will follow; however should you have questions on specific grievances, please reach out to your local grievance representative.
