        Alaska Airlines Management’s Unlawful Continued Denial of Washington State Sick Leave Law

        Washington’s Paid Sick Leave Law went into effect on January 1, 2018, which in part allows Flight Attendants to use sick leave to care for themselves or a family member – including preventative care – and for which they cannot be disciplined or given attendance points.  The industry trade association Airlines for America and Alaska Airlines management refused to comply with the law and spent the last four years litigating whether they had to or not; they ultimately lost in litigation, and the US Court of Appeals for the 9th Circuit decision in favor of the State of Washington and AFA stands.  Management still refuses to comply with the law, so AFA needs Seattle-based Flight Attendants to file complaints with the State of Washington Labor & Industries agency to ensure the law is rightfully applied.

        October is Domestic Violence Awareness Month

        Domestic violence can affect anyone and abusers can come from any demographic or background.  Though there is no single defining personality of an abuser, abusers may display common traits or exhibit certain warning signs.  If you or someone you know is affected by domestic abuse, confidential help is available through your AFA EAP Committee at (949) 470-0493 or afaalaska.org/eap.

        As part of the ongoing efforts of the Scheduling Committee to assist Flight Attendants in understanding contractual language and compensation, it was recommended a flow chart related to reassignments under contract sections 10.R and 10.R.5 be produced and published.  The first flow chart is designed to help you understand your rights and obligations in the event that you are subject to a reassignment by Crew Scheduling.  The second flow chart will help you understand what pay you are due for a sequence containing a reassignment.

        Government Affairs Committee

        • The Federal Aviation Administration (FAA) finalized a rule earlier this week requiring a minimum of 10 hours of irreducible rest for Flight Attendants between duty periods.
        • Though Alaska Flight Attendants have benefitted from contractual language ensuring scheduled rest of greater than 10 hours between duty periods for over a decade, this rule brings similar protections to all Flight Attendants throughout the industry.
        • This rule change is the culmination of tireless advocacy by members of our AFA Government Affairs Committee and other Flight Attendant activists from every airline.

        The Federal Aviation Administration (FAA) earlier this week finalized a rule requiring 10 hours minimum, non-reducible rest for Flight Attendants between duty days – finally implementing a 2018 law that will make aviation safer for over 100,000 Flight Attendants and the passengers in our care. The rule will increase the rest period to 10 irreducible hours when scheduled for a duty period of 14 hours or less. Though Alaska Airlines Flight Attendants have had contractual language guaranteeing greater than 10 hours of scheduled rest between duty periods since 2006 and Alaska management and AFA implemented 10 hours of irreducible rest in June 2020, equivalent protections have not been in place for all other Flight Attendants across the industry up to this point.

        “After years of fighting for the Fight For 10, the FAA on October 4, 2022 finalized 10 hours minimum rest. This is a pivotal moment for the aviation industry and we owe our thanks to the dedicated Flight Attendants from our Government Affairs Committee. For years our Committee Members fought hard and worked with our elected Representatives to make our careers safer by fighting to give us proper rest. Thank you for your dedication and commitment to achieving this milestone,” said Martin Monteblanco, AFA Alaska MEC Government Affairs Committee Chairperson.

        SFO ISC Update

        The Inflight Service Committee met with management at their quarterly meeting on September 21, 2022. The addition of the third cart on PLH flights is on management’s radar, but the ISC continues to advocate against this service. The lack of trash stowage, not enough supplies for three services, and long bathroom lines are the biggest concerns that have been brought forward. ISC’s goal is to work with the company to reach mutually agreeable solutions with the work group. Please continue to use Block2Block, FAIRs and ASAP to write up trash stowage concerns, flights loaded without empty carts in the AFT galley, and when supplies run out during cart service. Also, certain stations are implementing single door catering, potentially causing delays with boarding. Always notify CSAs that boarding cannot begin until the caterers finish blocking the aisle, and if it causes a delay it needs to be written as an FAIR and a safety hazard report. Other items that were brought to management’s attention include a time zone glitch on Block2Block when working Mexico flights, feedback regarding the main cabin menus needing a link to AlaskaReceipts.com for passengers, and reworking the menu layout to help avoid confusing pre order fresh food for picnic packs/retail snacks. 

        Supplemental Insurance Open Enrollment

        NGP offers services to include:

        NGP offers the following options:

        • Supplemental – these plans supplement any existing coverage
        • Voluntary – members choose to participate
        • Limited Underwriting – no medical or physical exams required

        • Portable – members can continue coverage if they leave the company
        • Payroll Deduction – premiums are paid through payroll deduction

        Bernstein v. Virgin America Lawsuit Updates

        A member of the Alaska legal team will be hosting CA base sits for September and October to answer Flight Attendant questions. Flight Attendants who take advantage of this opportunity are strongly encouraged to visit the Bernstein v. Virgin America subsite, on the plaintiff’s attorney webpage. This will provide for a well balanced viewpoint of the issue.

        Signs of Domestic Abuse

        Anyone can be an abuser. They come from all groups, all cultures, all religions, all economic levels, and all backgrounds. They can be anyone—your neighbor, your friend, your coworker, etc.  It is important to note that the majority of abusers are only violent with their current or past intimate partners. One study found 90% of abusers do not have criminal records and abusers are generally law-abiding outside the home. 

        Traits Abusers May Have in Common

        There is no one typical, detectable personality of an abuser. However, they may display common characteristics. An abuser often denies the existence or minimizes the seriousness of the violence and its effect on the victim and other family members. An abuser objectifies the victim and often sees them as their property or sexual objects. An abuser externalizes the causes of their behavior. They blame their violence on circumstances such as stress, their partner’s behavior, a “bad day,” on alcohol, drugs, or other factors. An abuser may be pleasant and charming between periods of violence and is often seen as a “nice person” to others outside the relationship. 

        Warning Signs of an Abuser

        Red flags and warning signs of an abuser include but are not limited to:

        • Extreme jealousy and/or possessiveness, even accusations of the victim flirting with others or having an affair.
        • Verbal abuse including blaming the victim for anything bad that happens
        • Extremely controlling behavior
        • Antiquated beliefs about roles of women and men in relationships
        • Sabotage or obstruction of the victim’s ability to work or attend outside activities
        • Controls all the finances
        • Control of what the victim wears and how they act
        • Demeaning and/or humiliating the victim either privately or publicly
        • Harassment of the victim at work

        Grievance Committee

        • Management still refuses to comply with the law, so AFA needs Seattle-based Flight Attendants to file complaints with the State of Washington Labor & Industries agency to ensure the law is rightfully applied.

        In 2018, a state law providing for paid sick leave went into effect in Washington State. Among other things, it required that employers provide:

        1. A minimum of one hour of paid sick leave for every 40 hours worked, and 
        2. The right to use your sick leave after 90 days of employment, not after the 180 days of employment (following probation) provided in our contract. 

        Under the law, you can use this time to care for yourself or a family member — including preventative care. Additionally, the use of paid sick leave time cannot be counted as an absence that leads to or results in any type of discipline – and you cannot be given attendance points.

        When the law went into effect in 2018, the MEC Grievance Committee contacted management to determine how they planned to implement the state law. We then learned that management had no intention of complying and instead would challenge the law through the court system.

        After four years of litigation and a win for the State of Washington and AFA in the 9th Circuit Court of Appeals, the U.S. Supreme Court recently denied management’s request to hear the case.

        As a result, the 9th Circuit’s ruling against Airlines for America (A4A) – including Alaska Airlines – is final, and no more appeals are possible. Even though the 9th Circuit’s decision in favor of the State of Washington and AFA is now binding, management still refuses to apply this law to Flight Attendants. They argue that litigation in district courts other the 9th Circuit that challenge how other states’ sick leave laws apply to flight crew could impact the application of the state law in Washington. 

        AFA strongly disagrees with management’s approach. We encourage Seattle-based Flight Attendants to file claims with the Washington State Department of Labor & Industries (L&I) if any of the following occur:

        1. You are given attendance points for calling in sick to care for yourself or a qualifying family member when you have accrued sick leave to cover the event,
        2. You are denied the use of sick leave for preventative care, or
        3. You are denied the use of paid sick leave after 90 days of employment (and prior to the end of your probationary period of 180 days). 

        While filing a claim can be time consuming, doing so helps you and your fellow crew members by protecting your rights and contributing to achieving what is legally due to you.

        Modification of Section 10.S – Pre-Cancellations

        AFA and management have recently come to an agreement to provide better clarity as to how pre-cancellations and reassignments are confirmed in advance of the first day of a sequence.  The agreement expands existing pre-cancellation language and provides protections to Flight Attendants in how Crew Scheduling handles a number of additional situations.  The new language goes into effect at midnight on Saturday, October 1, 2022.  If you have any questions, please contact your Local Scheduling Committee for more information.

        AFA Disaster Relief Fund

        We know that disasters can change lives forever. While we can’t stop destructive events from happening, we can, as a Union, assist our members with their recovery.         In accordance with Article VI.C of the AFA Alaska MEC Policy and Procedure Manual, the term of appointment for the MEC Committee Chairpersons is concurrent with those of the MEC Officers.  As the current MEC Officer term will end on December 31, 2022, the MEC will be conducting a review of all MEC Committee Chairperson and other MEC-level appointed positions at a Special MEC Meeting to be held November 29 through December 1, 2022.

        General Qualifications

        The following qualifications apply to all MEC-level Chairperson positions:

        • Previous experience as a Committee Member or Chairperson preferred (required for EAP).
        • Previous committee-specific training preferred (required for EAP).
        • Ability to attend meetings as required (primarily by videoconference and occasionally in-person).
        • Strong computer skills. Good working knowledge of Inflight Mobile Device, Google Workspace (email, calendar, and other software), and Microsoft Office.
        • Strong written and verbal communication skills. Ability to write membership communications, respond professionally to internal and external e-mail, prepare reports, and plan meetings agendas and take minutes.
        • Ability to meet deadlines, delegate responsibilities, and follow up on assigned tasks.

        The following qualifications apply to all Inflight Training Committee positions:

        • Current Inflight Instructor who is regularly assigned to Inflight Training Department responsibilities.

        Time Commitment and Flight Pay Loss Reimbursement

        Time Commitment and Flight Pay Loss for each position will be discussed during each interview.  All positions operate in accordance with AFA’s spirit of volunteerism.

        Expressing Interest and Interview Scheduling

        The MEC will hold interviews of eligible candidates during a special MEC meeting from November 29 through December 1, 2022.  If you’re interested in interviewing, plan to bid around these dates or adjust your schedule accordingly to accommodate.  All interviews will be conducted using Google Meet videoconferencing.

        Interested candidates should submit an expression of interest and resume online at https://forms.gle/xyvgfD9vzyJX5z8c6.  The deadline for submissions is 9 AM Pacific time on Saturday, November 19.  After the submission deadline, MEC Secretary-Treasurer Linda Christou will contact eligible candidates to arrange a specific interview time.

        Master Executive Council (MEC)

        • AFA and management have recently come to an agreement to provide better clarity as to how pre-cancellations and reassignments are confirmed in advance of the first day of a sequence.
        • The agreement expands existing pre-cancellation language and provides protections to Flight Attendants in how Crew Scheduling handles a number of additional situations.
        • The new language goes into effect at midnight on Saturday, October 1, 2022.  If you have any questions, please contact your Local Scheduling Committee for more information.

        AFA and management started discussions in 2018 regarding reassignments and pre cancellations related to Hurricane Lane, during which Crew Scheduling was found to be reassigning trips out of seniority order.  The issue was referred to the Alternative Dispute Resolution (ADR) process, agenda item 044-18A.  The parties discovered the language needed further clarification to assist Flight Attendants and Crew Schedulers on how to apply the provisions during these critical events as it relates to pre-cancellations, retimes, flight routing changes and aircraft downgrades that are confirmed in advance of the day of departure (i.e., first day) of a sequence.  Though conversations with management about the issue were ongoing, the ability to make significant progress in resolving the issue was hampered by COVID and network restructuring over the past several years.

        The product of those discussions resulted in the following letter of agreement (LOA), AFA SLOA 2022.09.09 Modification of 10.S Pre-Cancellations.  Please take time to review this agreement so you are aware of your contractual rights and obligations.  As part of the agreement, the following situations will now be handled according to the pre-cancellation provisions our collective bargaining agreement:

        • All retimes of the departure time of the first flight in a sequence
        • All retimes involving the arrival and/or departure times of any flight in a sequence of greater than two hours (2:00)
        • All retimes involving the later arrival time of the last flight in a sequence of greater than fifteen minutes (0:15)
        • A Company flight that is cancelled from a Flight Attendant’s line of time in advance of the day of departure even if such flight is replaced by a Capacity Purchase Agreement (CPA) flight operated as or on behalf of Alaska Airlines (e.g., Horizon Air, SkyWest) with the same flight number and/or routing as the cancelled flight. 

        The new language contained in the LOA goes into effect at midnight on Saturday, October 1, 2022.  Our MEC, Scheduling Committee, and Grievance Committee appreciates each of you filing reports and giving us the opportunity to carve out clarifying language that will support you going forward.

        Scheduling Committee

        • Our AFA Scheduling Committee Chairpersons met on Tuesday, September 27 to discuss their ongoing program of work to represent Flight Attendants interests related to lineholder scheduling.
        • The Committee also met with management to receive updates and discuss issues and problems that Flight Attendants are experiencing with scheduling, pairings, and bidding.
        • Your Local Scheduling Committee is available to answer questions, provide clarification, or help to resolve any lineholder scheduling-related issues.  Please don’t hesitate to reach out!

        On Tuesday, September 27, our AFA Scheduling Committee Chairpersons met to discuss their ongoing work to represent our Flight Attendants and push for improvements in our workplace. Representing you at the meeting were Heather Reier (ANC), Rita Tillou (SEA), Melodie Anderes (PDX), Jaqui Bellenie (SFO), Natalie Codd (LAX), and Kitty Cohen (SAN). Also present were MEC Scheduling Committee Chairperson Jake Jones, MEC Scheduling Committee Vice Chairperson—Pairing Construction Karen Ferrell, and MEC Scheduling Committee Vice Chairperson—PBS Adam Clarey. The committee met with Inflight Crew Scheduling Duty Manager Sara Cook, Director of Crew Staffing Nicholas Giles, and other management representatives from Crew Planning and Crew Scheduling.

        Topics of Discussion

        The committee reviewed a number of items both during internal AFA-only conversation and when meeting with management. Some items discussed include:

        • Concerns with charter bidding and ferry flight numbers that were not supposed to be in bid packets. These were pay protected under Section 10.W.  Crew Planning is developing processes to ensure compliance. 
        • Vacation bidding first round awards are posted.  Questions about whether the bidding instructions for vacation are adequate.   If not, what would Flight Attendants like to see added or removed. 
        • Preparations for winter operations.  Reminder to review Irregular Operations including but not limited to Section 8.S and 10.S.
        • New managers, supervisors and crew schedulers are joining Inflight Crew Scheduling. The committee reviewed that they do receive contract training, on the job training, work with instructors and high level crew access/crew exchange processing training.  The committee welcomes each of them to the department and look forward to working with them. 
        • Hotel and transportation issues.  Some Flight Attendants were required to vacate hotels during irregular operations in Newark.  This concern was referred to the Alternate Dispute Resolution (ADR) process as AFA believes there is a clear violation of the contract.  There are still reliability issues with some hotel transportation and are reviewing all concerns.
        • Upcoming large schedule reduction for flights operating on Thanksgiving.  This will affect layovers and holiday pay.  We will see more pairings with minimum pay rules that include EOR and MSM.  Want Flight Attendants to be aware of these changes. 
        • Asking for 4 position pairings (A/B/C/D) from Crew Planning.  This is under review. 
        • Line holders picking up reserve days may be sent to CARE Retreat as a reserve assignment.  Refer to the CARE Retreat LOA. 

        What The Committee Is Working On

        1. Reassignment Flow Chart.  Scheduling Committee Members reviewed a draft of the reassignment flow chart and it has been moved forward to the final stages of review and approval.  Refer to sections 10.R and 10.R.5 of our CBA.
        2. Scheduling Quality of Life Improvements.  Reviewing ways to improve Trip Length Distribution (TLD) and other quality of life options.  Working with management to develop a quality of life survey to determine Flight Attendant scheduling priorities. 
        3. Review of user guides and links of Flight Attendant website.  Ensuring information is still accurate in existing resource materials, links are still active and working, etc.
        4. Updating Crew Access videos.  Working with management and ITS to update the Crew Access instructional videos to reflect updates and changes to the user interface.
        5. Pre-Cancellation/Modification of Section 10.S LOA.  Working to familiarize Flight Attendants with the changes and update the flow chart.
